For the operation and maintenance of IT systems and company websites, as well as for the safeguarding of data security and the prevention of abusive or fraudulent behaviour, we only process the personal data of our users to the extent necessary to provide the our content and services.

 

Legal basis

We process your data for precontractual measures or contractual obligations (e.g., fulfilment of the GTC, Terms of Use, Art. 6 para. 1 step b of the GDPR), if required by law (Art. 6 para. 1 step c of the GDPR, e.g. consent to cookie use, safeguarding of adequate data security) and on the basis of Art. 6 para. 1 step f of the GDPR for the following (predominantly) legitimate interests:

Collection of data from other sources: categories of personal data

Each time our website is accessed, our system automatically collects data and information from the computer system of the calling computer. The following data is collected here:

• Information about the browser type and version used

• The operating system of the user

• The Internet service provider of the user

• The IP address of the user, session ID of the browser

• Date and time of access

• Data about the terminal device (device ID, screen resolution, language and country settings)

• Websites from which the user's system arrives at our website

• Websites that are called up by the user's system through our website.

 

Storage period

Data that is necessary for the functioning of the website is only processed and stored for the duration of your visit to our website. In addition, log data and IP addresses are as a rule stored for 7 days in order to protect against attacks on our systems, to clarify data security incidents and assert claims for damages if necessary until final settlement.

 

Provision of data

There is no legal or contractual obligation to provide the data, this is however required for the functioning of the website and our IT systems, which may otherwise be compromised.

In the case of a corresponding legitimate interest (amount of the order value), we establish creditworthiness before accepting an order.

In the online shop, cookies are used for the functioning of the shopping basket and the ordering process. They collect the following data:

Storage period

Until the termination of the business relationship or until expiry of the warranty, guarantee, limitation and legal retention periods applicable to the controller; in addition, until the termination of any legal disputes for which the data is required as proof. In particular, at least 10 years to prove fulfilment of fiscal and tax obligations (BAO), at least 22 years for real estate transactions. In the case of services for which claims for damages pursuant to the Austrian Civil Code (ABGB) or other titles (such as product liability) can be asserted, for the required duration. Cookies on the website are stored for a maximum of two years.

Provision of data

The collection of the data requested by us is required for a conclusion of contract.

Data processing when opening a customer account and for contract processing

Pursuant to Art. 6 para. 1 step b of the GDPR, personal data will continue to be collected and processed if you inform us of this for the performance of a contract or the opening of a customer account. The data that is collected can be seen from the respective input forms. Deletion of your customer account is possible at any time and can be done by sending a message to the above-mentioned address of the controller. We save and use the data you have provided for the execution of the contract. After full execution of the contract or deletion of your customer account, your data will be blocked with regard to tax and commercial retention periods and deleted after expiry of these periods, unless you have expressly consented to a further use of your data or a legally permitted further use of data was reserved by our side, about which we inform you accordingly hereinafter.

Storage period

Data of interested parties and profiles in online shops are stored for 3 years from the last customer contact. Postal addresses and email addresses are stored for the duration of advertising measures or until objection or until unsubscription from a newsletter;in addition, data is stored for up to three years after your unsubscription due to our accountability (proof of consent),  is stored if the restriction of processing is required or the processing for other purposes requires a longer storage period (in particular pursuant to Point 2 of the privacy policy).

 

Email newsletter

If you subscribe to our email newsletter, we will send you regular information about our products and offers. The only mandatory information required to send the newsletter is your email address. The disclosure of further possible data is voluntary and will be used to address you personally. To send the newsletter we use the so-called double opt-in process. This means that we will only send you an email newsletter if you have explicitly confirmed to us that you agree to the sending of the newsletter. We will then send you a confirmation email asking you to confirm by clicking on a corresponding link that you wish to receive newsletters in the future.

By activating the confirmation link, you give us your consent to the use of your personal data in accordance with Art. 6 para. 1 step a of the GDPR. When subscribing to the newsletter, we will save your IP address entered by the Internet Service Provider (ISP) as well as the date and time of registration in order to be able to trace a possible misuse of your email address at a later date. The data collected by us when registering for the newsletter will be used exclusively for promotional purposes by means of the newsletter. You can unsubscribe from the newsletter at any time using the link provided in the newsletter or by sending a message to the above-mentioned responsible person. Following successful cancellation, your email address will be immediately deleted from our newsletter mailing list, insofar as you have not expressly consented to a further use of your data or we reserve the right to further data usage, which is permitted by law and about which we inform you in this declaration.

Newsletter dispatch via Mailchimp

The dispatch of our email newsletter when registering via the website www.adler-lacke.com is carried out by the processor "MailChimp" of the US provider Rocket Science Group, LLC, 675 Ponce de Leon Ave NE #5000, Atlanta, GA 30308, USA. MailChimp is commissioned based on our legitimate interests in accordance with Art. 6 para. 1 step f. of the GDPR in the use of a promotional, secure and user-friendly newsletter system.
The Rocket Science Group LLC collects data processed in MailChimp in the USA on the legal basis of participation in the Privacy Shield Framework: https://www.privacyshield.gov/participant?id=a2zt0000000TO6hAAG=a2zt0000000TO6hAAG 
MailChimp uses this information for sending and statistical evaluation of the newsletter on our behalf. For the evaluation, the emails sent include so-called web beacons or tracking pixels, which represent one-pixel image files stored on our website. In this way it is possible to determine whether a newsletter message has been opened and which links have been clicked on, if necessary. Mailchimp uses web beacons to automatically generate general, non-personal statistics about the response behaviour to newsletter campaigns. Based on our justified interest in the statistical evaluation of the newsletter campaigns for the optimisation of advertising communication and the better orientation towards recipient interests, the web beacons in accordance with Art. 6 Para. 1 step f of the GDPR also collect and process data of the respective newsletter recipient (email address, time of retrieval, IP address, browser type and operating system). 

This data allows individual conclusions to be drawn about the newsletter recipient and is processed by Mailchimp to automatically generate statistics that show whether a particular recipient has opened a newsletter message. If you want to deactivate the data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter. 

In accordance with Art. 6 para. 1 step f of the GDPR, MailChimp may also use this data itself for its own legitimate interest in designing and optimising the service to meet its needs and for market research purposes in order to determine, for example, from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them or pass such data on to third parties. 
 

Advertising by mail

Based on our legitimate interest in personalised direct marketing, we reserve the right to store your first and last name, postal address and, if we have received this additional information from you as part of the contractual relationship, your title and your business name in accordance with Art. 6 para. 1 step f of the GDPR and use them for sending interesting offers and information about our products by mail.

The provider is Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). For this purpose, Google sets a cookie in the browser of your terminal device, which automatically enables interest-based advertising using a pseudonymous cookie ID and based on the pages you have visited. The processing takes place on the basis of our legitimate interest in the optimal marketing of our website pursuant to Art. 6 para. 1 step f of the GDPR. We process applicant data on the basis of Art. 6 para. 1 step b of the GDPR (precontractual measures) as well as Art. 6 para. 1 step f of the GDPR, in order to be able to contact you for the intended storage period for the selection of applicants and, if necessary, to check your details in individual cases, if this is in our interest or is necessary in the interest of third parties for a position due to particularly high demands on your trustworthiness.

Recipients or categories of recipients and transfers to third countries or to international organisations

Your data will only be disclosed to our employees if necessary. With specified references, it may on a case-by-case basis result in making contact. Similarly, in justified cases where there is a corresponding overriding interest, a review of your information may be carried out by third parties (for example, qualifications and university degrees submitted). If you have applied for a vacancy, we will store your personal data for a maximum of three years from the end of the application process and then delete it, whereby you have an unrestricted right to object at any time from eight months after the end of the process. If you have submitted an unsolicited application we will save your documents for a maximum of three years in order to be able to contact you for suitable vacancies, whereby you have an unrestricted right to object to the processing at any time.

Provision of data

In any case, in order to complete the application process, you must provide proof of having the qualifications required for the position to be filled and provide contact details. In individual cases, depending on staffing requirements, it may also be necessary for us to request further information from you (such as an extract from the criminal record). If you do not provide the mandatory data, your application cannot be considered for the position.

Further processing of your data for other purposes

In the event of taking up an employment contract, your application documents will continue to be used for the purposes of human resources management, with the exception of sensitive data (such as an extract from the criminal record).
